Question:
My Vietnamese wife and I are both non-resident workers. She decides to cancel her ‘Non-resident Worker’s Authorization to Stay’. Instead, she will apply for ‘Special Authorization to Stay’ for non-resident worker’s reuniting family and continue to stay in Macao with me. Do we need to submit a Certificate of Criminal Record issued by the competent authorities of Vietnam when we apply for the ‘Special Authorization to Stay’?
Answer:
No. This is because the policy is only applicable to Vietnamese citizens who apply for ‘Non-resident Worker’s Authorization to Stay’. However, according to Article 88 of the current “Code of Administrative Procedure”, the Public Security Police Force can request persons who apply for ‘Special Authorization to Stay’ for non-resident worker’s reuniting family to provide a Certificate of Criminal Record issued by their country of nationality.
