Article 60 “Obligation of Transportation Operators to Provide Information” of Law No. 16/2021 “Legal Regime of Immigration Control, Stay and Residence Authorization of the Macao Special Administrative Region” came into effect on 16 November 2022. The obligation to provide information by the transportation operators is regulated in the article.

Article 60 of Law No. 16/2021 requires the commercial business owners engaged in air transport and owners of air transportation not for commercial use to transmit the information of all the passengers and the cabin crew to the Public Security Police Force after the completion of passenger boarding procedure. By referring to international standard and as a general practice around the world, the regulation helps the Public Security Police Force in perfecting the immigration control of inbound air passengers, preventing crimes and enhancing immigration clearance efficiency.

The Macao Special Administrative Region Government enacted Administrative Regulation No. 47/2022 “Complementary Regulations on Advance Passenger Information System” according to Item 4, Article 101 of Law No. 16/2021 to regulate the content and preservation period of the information transmitted by the above-mentioned proprietors and owners, the transmission means and other technical conditions so as to ensure that the information to be transmitted is handled securely.

As the above article and administrative regulations come into effect, if the proprietors and owners do not carry out the obligation of information transmission, or the way they carry out the obligation is incorrect, incomplete, untruthful or overdue, or they do not transmit the information in a secure or appropriate way, they will be fined according to the law. If the inappropriate handling of information involves criminal elements, the Public Security Police Force will follow up in accordance with the law.
