《監獄法》修改語境下的罪犯內部申訴制度構建探

摘要：
本文聚焦於《監獄法》修改背景下罪犯內部申訴制度的構建。《監獄法》第7條規定了罪犯申訴及其他未被依法剝奪、限制的權利不受侵犯，但是該權利保障和實現需要在法律制度上完善。罪犯與監獄發生糾紛或者受到處罰時，為了使作為弱勢一方的罪犯得到完善的權利救濟，需要在監獄建立內部申訴制度。罪犯內部申訴制度是為了解決罪犯與監獄之間內部糾紛處理的權利救濟制度。當下罪犯內部申訴權保障的制約瓶頸主要是罪犯內部申訴權重視不夠，監獄立法上不夠完善，罪犯內部申訴渠道不暢，處理程序不規範，監獄高度封閉的環境致使外界監督乏力。結合《監獄法》修改帶來的新契機與新要求，罪犯內部申訴制度的構建，需要在《監獄法》中完善罪犯內部申訴權表述，明確內部申訴案件的管轄、審理、申訴程序等，構建科學合理的罪犯內部申訴制度。

Abstract：
This article focuses on the construction of the internal appeal system for convicts under the background of the revision of the Prison Law. Article 7 of the Prison Law stipulates that convicts’ right to appeal and other rights not legally deprived or restricted shall not be infringed. However, the protection and realization of these rights requires systemic refinement within the legal framework. Regarding convicts’ disputes with the prison or the punishments they face, an internal appeal system must be established within the prison to ensure comprehensive remedies for the rights of convicts, who are the weaker party in such conflicts. The internal appeal system for convicts serves as a rightsredress mechanism to resolve disputes between convicts and the prison. Currently, the constraints on the protection of convicts’ rights to internal appeal include: insufficient emphasis on the importance of such rights, inadequate legislative efforts for prison-related laws, unclear channels for internal appeals, non-standardized procedures for handling appeals, and the highly closed environment of prisons that weakens external oversight. In light of the new opportunities and requirements brought by the revision of the Prison Law, the construction of an internal appeal system must be strengthened. This includes improving the wording of convicts’ internal appeal rights in the Prison Law, clarifying jurisdiction, adjudication, and appeal procedures for handling internal appeal cases, and establishing a scientific and reasonable internal appeal system.
