我國公安機關職權屬性之考察

摘要：
公安機關的職權屬性問題實質是公安機關的職權結構問題，不僅關涉警察權的類型結構、實踐方向、控權方式等理論問題，還決定了警察執法信息公開、執法對象權利救濟途徑及申請賠償程序等實踐問題。公安機關職權屬性歷經了從“行政軍事雙重屬性”到“行政司法雙重屬性”的立法變革，從消極排除訴訟到積極二元處置的司法實踐演變，從激烈紛爭到日趨同意的理論變遷，最終目的是實現公安機關職權的法治化。

The Research on the Power Attributes of Public Security Organs

Abstract：
The essence of the power attributes of public security organs is the issue of the power structure of these entities, which not only involves theoretical issues such as the structure, practical orientations and control methods of police power, but also determines practical issues such as the disclosure of information, remedies for rights and procedures of compensation application. The power attributes of public security organs have undergone legislative changes from a“dual nature of administrative and military attributes” to a “dual nature of administrative and judicial attributes”, an evolution of judicial practice from passive exclusion of litigation to active binary disposal, and theoretical changes from intense disputes to increasingly agreed. In any case, the ultimate goal is the legalization of the powers vested in public security organs.
