  A. Target Groups
    "Non-resident workers" and their employers.
  B. Application Eligibility
   
1. Employers possessing valid "employment authorization";
2.
"Non-resident workers" meeting the stipulation relevant to the system of entry, stay and residence authorization in Macao (e.g. 1. in possession of a valid passport/travel document/identification document for entry to and departure from Macao; and 2. not in a lawfully restricted status).
  Application Approach
  Applicant:
  1.
Application for "Non-resident Worker's Card" can be made by any one of the following persons or entities:
   
(1) Employer;
(2)
Licensed employment agency appointed by the employer; [Note: For details, please see the Labour Affairs Bureau's website at http://www.dsal.gov.mo/.]
(3) Legal representative of persons listed in Points (1).
  [Note: The legal representative should submit the following:
 
1. A certified letter of authorization;
2.
Copy of his/her valid identification document (the original should be exhibited for authentication).]

  Application Procedures and Necessary Documents
  I.
Skilled, non-skilled workers and domestic helpers from Mainland China
   
A. Preliminary Examination
 
1.
The written instruction and official notification regarding the "employment authorization" should be presented and the following documents should be submitted to the Subdivision concerned:
 
(1)
A completed application form for "Authorization to Stay for Non-resident Workers" ("application form" for short) and a copy of it;
(2) 1 recent colour photo of 1.5-inch, full face, no-hat, white-background;
(3) Copy of the People's Republic of China Resident ID;
(4)
Copy of the joint statement of labour cooperation (employers of domestic helpers only).
2.
The applicant may inquire about the result through the "Inquiry System of Progress of Application for "Authorization to Stay for Non-resident Workers" in the Preliminary and Initial Examination Phases (applicable to non-skilled workers and domestic helpers from Mainland China)", or by presenting the "receipt of application" in person (or through the employer or employment agency) to the Subdivision around 5 working days after the above documents are properly submitted. If the application is approved, the applicant is required to collect from the Subdivision the preliminarily approved "application form" and the relevant copies, with which he/she can apply to the border control department in the Mainland for a “P.R.C. Permit for Travelling to and from Hong Kong and Macao” (hereafter call "Two-way Exit Permit" for short) and an endorsement for the "non-resident worker". Then the applicant may proceed to the formal examination procedures.
B. Formal Examination
 
1.
After the Preliminary Examination result is out, the Subdivision concerned will conduct a detailed examination of the application. The "non-resident workers" should go to the Subdivision concerned in person for inquiry of the examination result after he/she enters Macao with "Two-way Exit Permit" and "type (D) Stay Endorsement".
2.
If it is approved, the application for "Authorization to stay for the Non-resident Workers" can enter Final Examination directly.
 
(1)
The "non-resident workers" should go to the Subdivision concerned in person for payment of the processing fee and other procedures and submit the following documents:
 
i. Approved "application form" and a copy of it;
ii.
"Two-way Exit Permit" in book type holders shall submit the inside page containing "Type D-Stay endorsement", while "Two-way Exit Permit" in card type holders shall submit the back copy containing "Type D-Stay endorsement";
iii. A completed "Declaration of Identification";
iv.
Copy of other certificates or documents (specifically named in the "employment authorization" written instruction).
(2)
Upon completion of the procedure, the Subdivision will issue a "Revenue Receipt" and grant "Authorization to Stay for Non-resident Workers" (which expires on the same date as that of the "Non-resident Worker's Identification Card", hereafter called "Non-resident Worker's Card" for short).
C.
In special situations, the application for "Authorization to Stay for Non-resident Workers" cannot enter Final Examination but has to be further examined in Initial Examination.
 
1) Initial Examination
 
(1)
The written instruction and official notification regarding the "employment authorization" should be presented and the following documents should be submitted to the Subdivision concerned:
 
i. Approved "application form" and a copy of it;
ii.
"Two-way Exit Permit" in book type holders shall submit the inside page containing "Type D-Stay endorsement", while "Two-way Exit Permit" in card type holders shall submit the back copy containing "Type D-Stay endorsement";
iii.
Copy of other certificates or documents (specifically named in the "employment authorization" written instruction).
(2) After submission of the above documents:
 
i. For non-skilled workers and domestic helpers:
 
The applicant may inquire about the result through the "Inquiry System of Progress of Application for "Authorization to Stay for Non-resident Workers" in the Preliminary and Initial Examination Phases (applicable to non-skilled workers and domestic helpers from Mainland China)", or by presenting the "receipt of application" in person to the Subdivision around 5 working days after the above documents are properly submitted. If the application is approved, the applicant is required to collect from the Subdivision the initially approved "application form".
ii. For skilled workers:
 
Initial Examination of the application is instantaneously conducted. If the application is approved, the initially approved "application form" will be returned instantaneously.
(3)
After entering Macao, the "non-resident worker" may apply to the Subdivision for "Temporary Authorization to Stay for Non-resident Workers" in person (or through the employer or employment agency) with the "application form", valid "Two-way Exit Permit" and "Type (D) Stay Endorsement". Then the "non-resident worker" can remain and temporarily work in Macao legally until the Authorization expires.
2) Final Examination
 
(1)
The Subdivision concerned will conduct a detailed examination of the application and make a final decision before the "Temporary Authorization to Stay for Non-resident Workers" expires.
(2)
The "non-resident worker" should go to the Subdivision in person for inquiry of the result on the expiry date of the Authorization (or the date specified by the authorities). If the application is approved, the "non-resident worker" is required to be fingerprinted, pay the application fee and submit the following:
 
i. The approved "application form";
ii. A completed "Declaration of Identification.
3)
Upon completion of the procedure, the Subdivision will issue a "Revenue Receipt" and grant "Authorization to Stay for Non-resident Workers" (which expires on the same date as that of the "Non-resident Worker's Identification Card").
D.
There are the following situations after the Non-resident’s Working Permit has been approved,
 
1)
While applying the Non-resident Worker’s Identification Card, the non-resident holds electric "Two-way Exit Permit" in card type, who authorized to use the fingerprint information, is available to use the E-channel with the above document.
2)
While applying the Non-resident Worker’s Identification Card, the non-resident holds electric "Two-way Exit Permit" in card type, who did not authorize to use the fingerprint information, is not available to use the E-channel with the electric "Two-way Exit Permit" in card type. But Non-resident Worker can bring along the original of "Two-way Exit Permit" and the revenue receipt and come in person to the designated locations within office hours to Register for Automated Passenger Clearance System (e-Channel), then the E-channel is available to use with the above document after granted the Non-resident Worker’s Identification Card.
3)
Non-resident workers not belong to the above point 1) and 2), can bring along the original of "Two-way Exit Permit" and the revenue receipt, then the E-channel is available to use with a registered "Two-way Exit Permit" or Non-resident Worker’s Identification Card. [For details, please refer to "Registration for Automated Passenger Clearance System (e-Channel) for Non-residents"]
E. Card Collection
 
On the date of collection specified on the Revenue Receipt, the non-resident worker should bring the Receipt to the Subdivision concerned, Zone K, 1/F, Centro de Serviços da RAEM or Zone C, 3/F, Centro dos Serviços da RAEM das Ilhas,to collect the 'Non-resident Worker's Identification Card'. He or she may also authorize a third person (the employer / the employment agency authorized by the employer / a legal representative) to collect the Card on his or her behalf. To learn about the readiness of the Card, the non-resident worker may refer to the "Inquiry System of the Date of Collection of the ‘Non-resident Worker’s Identification Card’" or call (853) 2872 5488.
     
  II.
Skilled and non-skilled workers and domestic helpers from countries and regions other than Mainland China
   
A. Formal Examination
 
1. Initial Examination:
 
(1)
The written instruction and official notification regarding the "employment authorization" should be presented and the following documents should be submitted to the Subdivision concerned:
 
i.
A completed application form for "Authorization to Stay for Non-resident Workers" (hereafter called the "application form" for short) and a copy of it;
ii.
Copy of valid passport/travel document (bio data page only) or identification document used for entry to and departure from Macao;
iii.
1 recent colour photo of 1.5-inch, full face, no-hat, white-background;
iv.
Copy of employer's valid identification document (employers of domestic helpers only; the employer's signature on the copy of his/her identification document is required if he/she is also a "non-resident worker" or a "Special Stay Permit" holder, and submit the copy of his/her "Special Stay Permit" or "Non-resident Worker's Identification Card");
v.
Vietnamese are required to submit the original of Judicial Record Card No.2 issued by the competent authorities of Vietnam (For details of the time effect and authentication requirements, please see "Acceptance Standard for Documents");
vi.
Copy of other certificates or documents (specifically named in the "Employment Authorization" written instruction).
(2) After submission of the above documents,
 
i. For non-skilled workers:
 
The applicant may inquire about the result through the "Inquiry System of Progress of Application for "Authorization to Stay for Non-resident Workers" in the Preliminary and Initial Examination Phases (applicable to non-skilled workers and domestic helpers from Mainland China)", or by presenting the "receipt of application" in person to the Subdivision around 5 working days after the above documents are properly submitted. If the application is approved, the applicant is required to collect from the Subdivision the initially approved "application form".
ii. For skilled workers and domestic helpers:
 
Initial Examination of the application is instantaneously conducted. If the application is approved, the initially approved "application form" will be returned instantaneously.
(3)
After entering Macao, the "non-resident worker" may apply to the Subdivision for "Temporary Authorization to Stay for Non-resident Workers" in person (or through the employer or employment agency) with the "application form" and a valid identification document. Then the "non-resident worker" can remain and temporarily work in Macao legally until the Authorization expires.
B. Final Examination
 
(1)
The Subdivision concerned will conduct a detailed examination of the application and make a final decision before the "Temporary Authorization to Stay for Non-resident Workers" expires.
(2)
The "non-resident worker" should go to the Subdivision in person for inquiry of the result on the expiry date of the Authorization (or the date specified by the authorities). If the application is approved, the "non-resident worker" is required to be fingerprinted, pay the application fee and submit the following:
 
i. Copy of the approved "application form";
ii. A completed "Declaration of Identification".
(3)
Upon completion of the procedure, the Subdivision will issue a "Revenue Receipt" and grant "Authorization to Stay for Non-resident Workers" (which expires on the same date as that of the "Non-resident Worker's Identification Card").
C.
After the Non-resident’s Working Permit has been approved, the "non-resident worker" can bring along the original of the valid identification document, which is used to apply the Working Permit and the revenue receipt and come in person to the designated locations within office hours to Register for Automated Passenger Clearance System (e-Channel). D. Card Collection
 
On the date of collection specified on the Revenue Receipt, the non-resident worker should bring the Receipt to the Subdivision concerned, Zone K, 1/F, Centro de Serviços da RAEM or Zone C, 3/F, Centro dos Serviços da RAEM das Ilhas,to collect the 'Non-resident Worker's Identification Card'. He or she may also authorize a third person (the employer / the employment agency authorized by the employer / a legal representative) to collect the Card on his or her behalf.   Remark
  I. Date of issue and expiry of "Non-resident Worker's Card"
   
A. Date of Issue: Same as that of the "Revenue Receipt"
B. Date of Expiry:
Correspondent with the limit approved by the Secretary for Economy and Finance or the Director of the Labour Affairs Bureau in the Employment or Work Authorization, unless a shorter term has to be granted according to the stipulation in the system of entry, stay and residence authorization of the Macao Special Administrative Region.
  II.
Languages Used in the Fields of Employing Entity and Occupation on the "Non-resident Worker’s Card"
   
1.
The information regarding the employing entity and occupation on the "Non-resident Worker’s Card" will be printed exactly in the languages (Chinese / Portuguese, or Chinese and Portuguese) indicated in the Labour Affairs Bureau’s ‘employment authorization’. [Location of the Fields of Employing Entity and Occupation]
2.
Therefore, if an employer (or employee) requests both Chinese and Portuguese languages or the other official language (e.g. request for Portuguese while the ‘employment authorization’ is in Chinese) to be printed in the fields of employing entity and occupation on the "Non-resident Worker’s Card" while the Labour Affairs Bureau’s ‘employment authorization’ shows the information in only one language (Chinese or Portuguese), the employer should make the request to the Labour Affairs Bureau first and have the ‘employment authorization’ updated before we proceed accordingly.
  III. Penalty for overstay
   
1.
According to Administrative Regulation No. 14/2014 'Amendments to the Provision on Overstay in the 《Regulations of the Entry, Stay and Residence Authorization》', persons who still stay in the Macao SAR but not over 30 days after the expiry of the authorization granted is fined MOP500 per overdue day from 9/7/2014. The violators are required to pay the fine immediately after they are arrested or report themselves to the police. The above mentioned penalty regulation is not applicable to those who have overstayed in Macao within one year. Those will be considered to be illegal immigrants if they do not pay the fine and the penalty regulation is not applicable to them. Moreover, they cannot make any application for Residence Authorization, extension of Authorization to Stay and Authorization to Stay for Non-resident Workers within two years to the Residence and Stay Affairs Department.
2.
According to Law No. 6/2004, persons who are considered to be illegal immigrants will be deported and interdicted from entry to the Macao SAR for the period indicated in the deportation order.
  IV.
If the non-resident worker / reuniting kindred of the non-resident worker / "Special Stay Permit" holder renews the passport / travel document / "Two-way Exit Permit" / identification document used for application for the "Authorization to Stay" in Macao, he or she is required to bring the renewed document to the Subdivision concerned for update of the document information and application for reissue of the "Slip of Authorization to Stay".
